1. About Moanara

Moanara ("we," "us," "our") is an AI-powered travel planning platform that helps users discover, compare, and book accommodations and travel services. We operate as an intermediary, connecting travelers with hotels and travel providers.

Important: Moanara is a travel search and comparison service. When you book through our platform, your contract is with the hotel or travel provider, not with Moanara, unless explicitly stated otherwise.

2. Account Registration

• You must be at least 18 years old to create an account
• You must provide accurate and complete information
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized access
• One person may not maintain multiple accounts

3. Bookings and Payments

Booking Process

When you make a booking through Moanara, you enter into a contract directly with the accommodation provider. We facilitate this transaction but are not a party to the contract between you and the provider.

Pricing

• All prices are displayed in your selected currency and include applicable taxes unless otherwise stated
• Prices are subject to availability and may change until booking is confirmed
• Our commission (typically 8-10%) is included in displayed prices
• Additional fees (resort fees, city taxes) may apply and will be disclosed before booking

Payment Processing

Payments are processed securely through Stripe. By making a payment, you authorize us to charge your payment method. We do not store your full payment card details on our servers.

4. AI Services and Recommendations

Moanara uses artificial intelligence to provide travel recommendations, price predictions, and personalized suggestions. Please understand:

• AI recommendations are suggestions, not guarantees
• Price predictions are estimates based on historical data and may not be accurate
• You are responsible for verifying information before making booking decisions
• AI chat conversations may be reviewed to improve our services

5. Prohibited Activities

You agree not to:

• Use the platform for any unlawful purpose
• Make fraudulent bookings or provide false information
• Attempt to circumvent security measures or access restricted areas
• Scrape, crawl, or use automated tools to extract data
• Resell or commercially exploit our services without permission
• Interfere with the platform's operation or other users' experience
• Upload malicious code or attempt to compromise our systems
• Impersonate others or misrepresent your affiliation

6. Intellectual Property

All content on Moanara, including text, graphics, logos, images, and software, is owned by Moanara or our licensors and protected by intellectual property laws.

• You may not copy, modify, or distribute our content without permission
• The Moanara name, logo, and brand elements are our trademarks
• User-generated content (reviews, photos) remains your property, but you grant us a license to use it

7. Limitation of Liability

Some jurisdictions do not allow limitation of liability for certain damages. In such cases, our liability is limited to the maximum extent permitted by applicable law.

8. Indemnification

You agree to indemnify and hold harmless Moanara, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the platform, violation of these terms, or infringement of any third-party rights.

9. Dispute Resolution

For booking-related disputes, please first contact the accommodation provider directly. If unresolved, contact our support team at [email protected].

These terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of Amsterdam, Netherlands, unless mandatory consumer protection laws in your jurisdiction require otherwise.

10. Termination

We may suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. You may delete your account at any time through your account settings.

Upon termination, your right to use the platform ceases immediately. Provisions that by their nature should survive termination (including liability limitations and dispute resolution) will remain in effect.

11. Changes to Terms

We may modify these terms at any time. We will notify you of material changes via email or a prominent notice on our platform. Continued use after changes constitutes acceptance of the new terms.
